1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and KU LABS LLC (“Blurtly,” “we,” “us,” or “our”). By accessing or using Blurtly, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. Children under 13 may not create or use an individual account unless their use is appropriately authorized and administered by a parent, guardian, school, or other authorized organization.
3. Accounts
You are responsible for providing accurate account information, safeguarding access to your account, and notifying us if you suspect unauthorized use. You may not share, sell, or transfer your account in a way that compromises the service or another person’s rights.
You may delete your account through the account settings in the app. We may suspend or terminate an account that violates these Terms, creates risk for Blurtly or others, or must be restricted to comply with law.
4. The Blurtly service
Blurtly provides tools for language learning and speaking practice, including personalized exercises, translations, generated speech, transcription, and feedback. We may add, change, suspend, or discontinue features, including during beta testing.
Blurtly is an educational aid, not a professional translation, interpretation, medical, legal, or emergency service. Do not rely on it where an inaccurate translation or response could cause harm.
5. AI-generated content
Some Blurtly content is generated or evaluated using artificial intelligence. AI output can be incomplete, inappropriate, or incorrect. You are responsible for reviewing output before relying on, sharing, or using it in a real-world conversation.
Your prompts, learning content, and voice data may be processed by the providers described in our Privacy Policy to deliver these features.
6. Your content
You retain any rights you have in content you submit to Blurtly. You give us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, and transform that content only as reasonably necessary to operate, secure, and improve the service.
You represent that you have the rights needed to submit your content and that doing so does not violate the law or another person’s rights.
7. Acceptable use
You may not:
- use Blurtly for unlawful, fraudulent, or abusive conduct;
- submit content that exploits children, promotes violence, or violates another person’s privacy or intellectual-property rights;
- attempt to bypass security, access another user’s account, or interfere with the service;
- use automated means to scrape, overload, or extract data from the service without our permission; or
- reverse engineer or misuse the service except where applicable law expressly permits it.
8. Our intellectual property
Blurtly and its software, design, branding, and other service materials are owned by KU LABS LLC or its licensors and are protected by law. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the service; they do not transfer ownership of our intellectual property.
9. Third-party services
Blurtly relies on third-party services for authentication, AI processing, speech recognition, hosting, and other functionality. Their services may be governed by separate terms and may occasionally be unavailable. We are not responsible for third-party products or services outside our control.
10. Disclaimers
To the fullest extent permitted by law, Blurtly is provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, KU LABS LLC and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from your use of Blurtly. Nothing in these Terms limits liability that cannot legally be limited.
12. Changes and contact
We may update these Terms as the service changes. We will post the updated version here and revise the date above. If changes are material, we will provide additional notice when appropriate. Continuing to use Blurtly after updated Terms take effect means you accept them.
