Terms of Service

These Terms of Service explain the rules for using Blurtly. By accessing or using Blurtly, you agree to these Terms. If you do not agree, do not use Blurtly.

1. What Blurtly is

Blurtly is a language-learning app that helps users create vocabulary decks, practice speaking, review words and phrases, and generate learning exercises.

Blurtly is designed for learning support. It is not professional translation, academic, legal, medical, immigration, or professional advice.

2. Accounts

Some parts of Blurtly require an account. You are responsible for keeping your account and sign-in method secure.

You agree to provide accurate account information and to notify us if you believe your account has been accessed without permission.

You are responsible for all activity that occurs through your account.

3. Age requirements

Blurtly is not intended for children under 13.

If you are under the age of majority where you live, you may use Blurtly only with permission from a parent or legal guardian.

If Blurtly is later used by schools, tutors, parents, or younger learners, additional terms, consent, or school-specific requirements may apply.

4. Your content

You are responsible for the content you create, paste, upload, import, submit, or practice in Blurtly, including vocabulary, decks, prompts, study material, notes, sentences, and other learning content.

You keep ownership of your content. By using Blurtly, you give us permission to host, store, copy, process, transmit, display, modify, and use your content as needed to provide, secure, troubleshoot, personalize, and improve Blurtly.

Do not upload or use content unless you have the right to use it.

5. AI-generated learning content

Blurtly uses AI and speech-related services to generate or evaluate vocabulary decks, prompts, examples, pronunciation hints, translations, transcripts, feedback, and other learning material.

AI-generated content may be inaccurate, incomplete, unnatural, offensive, or otherwise unsuitable. You should review important material before relying on it.

Blurtly does not guarantee fluency, exam results, learning outcomes, pronunciation accuracy, translation accuracy, or any specific educational result.

6. Speaking practice and microphone use

Some features may require microphone access. Microphone access is controlled by your browser or device and only starts when you grant permission and begin a speaking exercise.

Speaking-practice data may be processed by speech, voice, transcription, or AI providers so Blurtly can run the exercise and provide feedback.

You can revoke microphone permission through your browser or device settings.

7. Acceptable use

You agree not to use Blurtly to:

  • Violate any law or regulation.
  • Infringe the rights of others, including copyright, trademark, privacy, or publicity rights.
  • Upload harmful, abusive, hateful, harassing, sexually explicit, exploitative, violent, or illegal content.
  • Generate spam, scams, fraud, or deceptive content.
  • Interfere with, overload, reverse engineer, scrape, attack, or disrupt Blurtly or its systems.
  • Attempt to access accounts, data, systems, or features you are not authorized to access.
  • Bypass limits, security measures, usage controls, or payment requirements.
  • Use Blurtly to build a competing product by copying its features, design, generated content structure, or user experience.

We may remove content, limit access, suspend accounts, or terminate accounts if we believe these Terms have been violated or if needed to protect Blurtly, users, providers, or the public.

8. Blurtly ownership

Blurtly, including the app, website, design, software, code, branding, interface, workflows, features, and related materials, is owned by Blurtly or its operators.

These Terms do not give you ownership of Blurtly or the right to copy, resell, sublicense, or commercially exploit the app.

9. Feedback

If you send us ideas, suggestions, bug reports, feature requests, or other feedback, you allow us to use that feedback without restriction or compensation to you.

10. Payments and subscriptions

Blurtly may offer paid plans, subscriptions, credits, trials, or other paid features in the future.

If paid features are added, pricing, billing terms, renewal terms, cancellation rules, refund rules, and any trial terms will be shown at or before purchase.

You are responsible for reviewing those terms before buying or subscribing.

11. Changes to Blurtly

We may change, update, pause, limit, or discontinue any part of Blurtly at any time.

We may also add or remove features, change limits, modify exercises, update AI providers, or adjust the way the app works as we improve the product.

12. Account deletion

You may stop using Blurtly at any time. If you want help deleting your account or data, contact us using the contact information below.

Some information may remain in backups, logs, security records, or records we are required or permitted to keep for legal, security, or legitimate business reasons.

13. Disclaimers

Blurtly is provided “as is” and “as available.”

To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not promise that Blurtly will be uninterrupted, secure, error-free, accurate, or suitable for every user, language, accent, level, learning goal, or exam.

14. Limitation of liability

To the fullest extent allowed by law, Blurtly and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost learning progress, business interruption, or loss of goodwill.

To the fullest extent allowed by law, Blurtly’s total liability for any claim related to the app or these Terms will be limited to the greater of:

  • the amount you paid to Blurtly in the 3 months before the claim, or
  • $25.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Blurtly and its operators from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your content, your use of Blurtly, your violation of these Terms, or your violation of someone else’s rights.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules.

17. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above.

Your continued use of Blurtly after changes means you accept the updated Terms.
